Welcome to the Ag Data Transparency Evaluator

This website was created by a non-profit corporation backed by a consortium of farm industry groups, commodity organizations and ag technology providers in order to bring transparency, simplicity, and trust into the contracts that govern precision agricultural technologies. Based upon the foundation laid by the Privacy and Security Principles for Farm Data (the Data Principles), the Ag Data Transparency Evaluator is a process by which ag technology providers voluntarily submit their ag data contracts to a simple, ten question evaluation. Answers are reviewed by an independent third party administrator, and the results are posted on this website for farmers and other ag professionals to consult and review. Only companies receiving approval are allowed to use the “Ag Data Transparent” seal.

Understanding Your Data Contracts

A consortium of farm organizations and agricultural technology providers met to address these concerns by first establishing and agreeing upon a set list of “Data Principles,” the Privacy and Security Principles for Farm Data. Building on the Data Principles this consortium moved on to developing a tool that can help farmers understand the key provisions in their contracts with providers regarding ownership, usage, and sharing of data generated by technology products.

What is the Ag Data Transparency Evaluator

This tool, called the Ag Data Transparency Evaluator, analyzes contract terms and conditions based on a set of 10 questions, boiling lengthy contracts down to simple yes or no answers. These allow producers to quickly and easily determine the answers to many concerns they have about their farm data. The answers provide hyperlinks to the actual contract terms as well, should farmers desire to dig deeper into any particular question.

Look for the Ag Data Transparent Seal on Qualifying Products

Products that go through the evaluator and are determined to meet the criteria established by the data principles will receive a seal, certifying that they are “Ag Data Transparent.” When farmers are shopping for technology products they can be confident when they see the seal, that their Ag Technology Provider’s (ATP) data and technology contracts mean what they say.

Conservis believes that you own your data. As defined in our Data Privacy Policy, with the exception of aggregated databases where personally identifiable data is masked, you exclusively own rights to the data. More Info

Conservis intends to work with business partners that have similar views on data privacy. Conservis will notify you if changes are made to applicable agreements. For additional details, please see our Data Privacy Policy More Info.

7. Will the ATP notify me if a breach of data security occurs that causes disclosure of my data to an outside party? Yes

8. Upon my request, can my original dataset be deleted when my contract with the ATP terminates? No

Your identifiable data can be deleted upon your request from Conservis active databases. Our archived and secured backups do retain account information but are separate from our active databases. View our Data Privacy Policy for more information. More Info

Conservis currently does not have a defined policy of removing data. We will notify you prior to such a policy coming into effect.

FARMOBILE PUC

1. What categories of data does the product or service collect from me?

Our product is designed to collect Agronomic data, land data, and machine data from your farm. Agronomic data consists of seed, planting, yield, pest management, and crop nutrition data. Land data refers to information such as tillage, soil, environmental, etc. Machine data is information on the health and operation of your machine. These terms are described in more detail in section 2.3 of our Equipment Lease and Data Upload Agreement. More

2. Do the ATP’s agreements address ownership of my data after my data is transferred? Yes

As explained in section 2.2 of the Equipment Lease and Data Upload Agreement, Farmobile believes that you (the farmer) are the owner of your Farm Data and that you should have the right to share, download, and delete your Farm Data.

3. If the ATP contracts with other companies to provide data related services, does the ATP require these companies to adhere to the ATP’s privacy policies with me? Yes

As explained in section 2.5 of the Equipment Lease and Data Upload Agreement, any 3rd party service provide used by Farmobile that may have access to your Farm Data is required to abide by these same terms.

4. Will the ATP obtain my consent before providing other companies with access to my data? Yes

As explained in section 2.7 of the Equipment Lease and Data Upload Agreement, Farmobile will not share your Farm Data with third parties without first obtaining your consent.

5. After I upload data to the ATP, will it be possible to retrieve my original complete dataset in an original or equivalent format? Yes

As explained in sections 2.6 of the Equipment Lease and Data Upload Agreement, Farmobile allows you and Trusted Advisors you approve to have access to view, and download your Farm Data anytime. Section 2.8 of the Equipment Lease and Data Upload Agreement explains your ability to remove your Farm Data from Farmobile.

6. Will the ATP notify me when its agreements change? Yes

As explained in section 6.1 of the Equipment Lease and Data Upload Agreement, no change in this Agreement shall occur without your continued consent.

7. Will the ATP notify me if a breach of data security occurs that causes disclosure of my data to an outside party? Yes

As explained in section 2.9 of the Equipment Lease and Data Upload Agreement, in the event of a data breach, natural disaster, or other unforeseen event, Farmobile will notify you by email.

8. Upon my request, can my original dataset be deleted when my contract with the ATP terminates? Yes

As explained in section 2.8 of the Equipment Lease and Data Upload Agreement, if you chose to terminate use of the PUC and Service, you may delete your Farm Data at any time during the Term. Farmobile shall keep Farm Data for thirty (30) days after termination in order to allow you to download your Farm Data.

Agrible, Inc.

Morning Farm Report

1. What categories of data does the product or service collect from me?

Information provided to Agrible by the user is voluntary and usage is governed by our General Terms and Conditions and our Privacy Policy. Depending upon the service selected by the user, Agrible currently collects Machine Data, Land Data, Agronomic Data and Farm Management Data (the terms are defined in Section 2.1 of the General Terms and Conditions). 2. Do the ATP’s agreements address ownership of my data after my data is transferred? Yes

As explained in Sections 9.2 and 9.3 of the General Terms and Conditions, the user is the sole owner of their data. The user grants Agrible a limited license to aggregate their data in an anonymized form. Aggregated data belongs to Agrible. More

3. If the ATP contracts with other companies to provide data related services, does the ATP require these companies to adhere to the ATP’s privacy policies with me? Yes

Agrible's Privacy Policy states that “Agrible discloses personally ­identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on Agrible's behalf or to provide services available at Agrible's website, and (ii) have agreed not to disclose it to others. Furthermore, Section 13.1 of the General Terms and Conditions states “The required data you provide, especially your name and address, are stored, processed and employed for fulfilling the Business Purposes.” Business Purposes if defined as 'fulfilling the contractual relationship between Agrible and you, for fostering existing relations with its Users, and for quality control and further development of the Morning Farm Report.' 4. Will the ATP obtain my consent before providing other companies with access to my data? Yes

Agrible's Privacy Policy states 'We do not sell, rent, lease, divulge or otherwise pass on your personal information to other third parties unless one of the following applies: (a) you give us consent to; (b) you would expect us to or we have told you that we will (for example, third parties such as payment processors or third­party vendors; or for us to improve our services); or (c) it is required or authorized by law.' 5. After I upload data to the ATP, will it be possible to retrieve my original complete dataset in an original or equivalent format? Yes

Section 13.2 of the General Terms and Conditions states that during the Subscription, 'Any Farm Data uploaded to Morning Farm Report by You is recorded and maintained in Morning Farm Report, and upon Your request to Agrible’s customer service, Agrible will use commercially reasonable efforts to make such data available to You.' Section 1.2 of the General Term and Conditions states that a notice of change to the General Terms and Conditions or to Agrible’s Privacy Policy will be sent to the user at the email address provided by the user . 7. Will the ATP notify me if a breach of data security occurs that causes disclosure of my data to an outside party? Yes

Section 11.4 of the General Terms and Conditions states: 'Agrible agrees to notify You via email when Agrible becomes aware of any unauthorized use of Your username, password, or any other breach of security that causes disclosure of Your data to third parties.' More

8. Upon my request, can my original dataset be deleted when my contract with the ATP terminates? Yes

Section 15.3 of the General Terms and Conditions states 'Upon termination of Your Morning Farm Report subscription You may request that Agrible remove Your data from our systems. Agrible will delete Your data within a reasonable time; provided, however, that Agrible will not have obligation to delete Aggregated Data and data needed for Agrible's recordkeeping and servicing purposes.' Section 13.2 of the General Terms and Conditions explains that Agrible shall retain all data provided by the user for at least thirty (30) days after termination of the subscription and that the user’s original data may be retained for up to five years. More

10. Do the ATP’s agreements address what happens to my data if the ATP is sold to another company? Yes

The Privacy Policy states in the Business Transfers section: 'If Agrible, or substantially all of its assets, were acquired, or in the unlikely event that Agrible goes out of business or enters bankruptcy, user information would be transferred to that third party. You acknowledge that such transfers may occur, and that any acquirer of Agrible may continue to use your personal information as set forth in this policy.' More

Granular

1. What categories of data does the product or service collect from me?

Granular collects any or all of these if the customer chooses to include: i. Operational and agronomic data such as plans or actuals related to planting, product application, scouting, irrigation and harvesting, including what products are used, which tasks are done, when, and by whom; ii. Land data such as digital shape files of customer’s field boundaries as well as ownership and lease information related to those field boundaries; iii. Financial data such costs associated with operational and agronomic activities, contracts and settlement information, and other data related to revenue, costs or resultant profit for a customer’s operation; iv. Machine data that is imported on a customer’s behalf from third-party equipment manufacturers or software companies; and v. Weather and climate data sourced through a proprietary weather stations or other sources. This is further contained in Section 1.12 of the Agreement More

2. Do the ATP’s agreements address ownership of my data after my data is transferred? Yes

As specified in our Section 3.1 of our Agreement - the producer owns the data that he/she puts into Granular. We reserve a license for certain use of that data, primarily for the farmer’s benefit, as outlined in our agreement. More

3. If the ATP contracts with other companies to provide data related services, does the ATP require these companies to adhere to the ATP’s privacy policies with me? Yes

Under Section 4.3 of our Agreement - we are bound to maintain the confidentiality of customers’ data when engaging other companies to provide data related services. Likewise, section 4.3 requires such other companies to maintain customers’ data as confidential. More

4. Will the ATP obtain my consent before providing other companies with access to my data? Yes

We are not permitted to provide third parties with access to your data except in two circumstances, as outlined in Sections 4.3 and 4.4 of our Agreement. 1) On a confidential basis to Our employees, service providers, consultants, representatives and agents who would need to have access to your data for the provision of Granular’s services; and 2) If disclosure was compelled by an applicable court, legislative or administrative body, under Federal or State law, or if necessary to protect personal safety or breaking the law. 5. After I upload data to the ATP, will it be possible to retrieve my original complete dataset in an original or equivalent format? Yes

Granular may in some cases convert customers’ data into a different digital format than originally submitted. However, the data is accessible by customers upon request during the term of their agreement or up to 30 days after terminating the service. This is outlined in Section 3.6 of our Agreement and Brand. More

6. Will the ATP notify me when its agreements change? Yes

Our commitment to provide notice of changes to our software services agreement is found in Section 10.3 of the Agreement - Provisions. In the event that we modify the terms, we will notify our customers of the change. The customers have the ability to consent to the changes by continued use of the Services or may contact Granular in the event they do not consent. More

We will notify customers if their data is inadvertently breached or disclosed to a third party, as specified in Section 10.5 of the Agreement - Provisions. More

Given how we incorporate customer data in our aggregate data set, the original data set cannot be deleted. However, as specified in Section 3.6 of our Agreement - and Brand - we will remove any identifying information from customers’ data upon request, within 30 days of terminating the service. More

Under Section 3.6 of our Agreement - and Brand - we agree to maintain a record of customers’ data for at least 30 days following termination of the services. More

According to Section 10.8 of the Agreement - Provisions - any successor of Granular would have the same rights and obligations with regard to customers’ data as Granular does today. More

AgIntegrated, Inc.

Onsite

1. What categories of data does the product or service collect from me?

Onsite collects normal identification information during account set up. Thereafter, Onsite collects any information the user transmits or receives through the Onsite service. This may include all categories of data, such as data files from machines, information about a user’s land, farm management data, agronomic data and weather and climate data, depending upon what information the user elects to send or receive through the Onsite system. These terms are described in our Privacy Policy.

2. Do the ATP’s agreements address ownership of my data after my data is transferred? Yes

As explained in our Privacy Policy, the user maintains ownership of all data and information that the user sends to Onsite.

3. If the ATP contracts with other companies to provide data related services, does the ATP require these companies to adhere to the ATP’s privacy policies with me? Yes

Only the user determines other companies or people with whom the user’s data may be shared through the Onsite service. The user does this by making elections within Onsite to allow the user’s data or information to be shared with third parties. Any third parties with whom the user elects to share data or information must also be authorized Onsite users, and therefore abide by the terms of service for Onsite and the Privacy Policy. Although cloud service providers utilized by the Onsite are not required to adhere to the Onsite’s privacy policies, these service providers do not have the ability to distribute or disclose your data.

4. Will the ATP obtain my consent before providing other companies with access to my data? Yes

As stated in our Privacy Policy, no other companies will be provided access to the user’s data without specific authorization from the user.

5. After I upload data to the ATP, will it be possible to retrieve my original complete dataset in an original or equivalent format? Yes

Provided all subscription amounts due have been paid and the subscription has not expired for more than 30 days, the user can obtain from Onsite the original data and information that the user transmitted to Onsite. Please view our Privacy Policy for more information.

6. Will the ATP notify me when its agreements change? Yes

Changes to Onsite’s Terms of Service and/or Privacy Policy will be posted on the website. Also, registered users will receive email notification if the Terms of Service or Privacy Policy changes.

7. Will the ATP notify me if a breach of data security occurs that causes disclosure of my data to an outside party? Yes

As explained in our Privacy Policy, Onsite will notify the user of any unauthorized data access of which Onsite becomes aware.

8. Upon my request, can my original dataset be deleted when my contract with the ATP terminates? Yes

Onsite will delete a user’s data upon request at any time and within thirty (30) days after the end of a subscription term. Onsite may retain an archival copy of a user’s data or information, without any further use or distribution of the user’s data except for Onsite’s protection. 9. Do the ATP’s agreements establish how long my original datasets will be retained? Yes

As long as the user remains a current subscriber of the Onsite service, the user’s datasets are maintained in backup versions. After a user’s subscription term has expired without renewal, the user’s data may not be returned to the user unless a request is made by the user within thirty (30) days after the subscription term ends. 10. Do the ATP’s agreements address what happens to my data if the ATP is sold to another company? Yes

The Onsite Privacy Policy requires that any new owner of the ATP will be obligated to abide by the Privacy Policy as it is in effect at that time. The new owner may change the Privacy Policy only in accordance with the terms (which require notice to the user).

Section 1 of the FARMserver Data Use Policy describes the three types of ag data FARMserver collects: Agronomic data: seed data, planting data, yield data, disease and pest management data, and crop nutrition data. Land data: tillage, water management, soil fertility, environmental data, geospatial information, and field boundary information. Weather data: precipitation, wind, temperature and other climate data. Machine data: information related to machine performance, such as speed, fuel usage, and engine rpm. More info

2. Do the ATP’s agreements address ownership of my data after my data is transferred? Yes

Under Section 2 of the Data Use Policy, you remain the owner of your Raw Data after it is transferred to FARMServer.

3. If the ATP contracts with other companies to provide data related services, does the ATP require these companies to adhere to the ATP’s privacy policies with me? Yes

Under Section 6 of the Data Use Policy, “Any third party service providers that FARMserver engages must agree to abide by this Data Use Policy and FARMserver’s Privacy Policy.”

4. Will the ATP obtain my consent before providing other companies with access to my data? Yes

Section 3 of the Data Use Policy provides: “FARMserver will not share your Raw Data unless you provide consent by selecting persons and designating the appropriate permission level in your account setting.”

5. After I upload data to the ATP, will it be possible to retrieve my original complete dataset in an original or equivalent format? Yes

Section 10 of the Data Use Policy states that you may download your Raw Data at any time by logging into FARMserver.

6. Will the ATP notify me when its agreements change? Yes

Section 8 of the Data Use Policy states: “FARMserver may periodically modify this Data Use Policy to reflect changes in FARMserver’s functionality, practices or policies. You will be notified by email or upon logging into your FARMserver account of any changes to this Data Use Policy.”

7. Will the ATP notify me if a breach of data security occurs that causes disclosure of my data to an outside party? Yes

Section 6 of the Data Use Policy states: “In the event of a data breach, natural disaster, or other unforeseen event that causes your Raw Data to be compromised, FARMserver will notify you by email or other matter required by law.”

8. Upon my request, can my original dataset be deleted when my contract with the ATP terminates? Yes

Section 10 of FARMserver’s Data Use Policy explains that your original dataset may be deleted after termination. The one exception is weather data, which will not be deleted.

9. Do the ATP’s agreements establish how long my original datasets will be retained? Yes

Section 10 of FARMserver’s Data Use Policy explains that FARMserver will retain copies of your original datasets for a period of 90 days following termination.

10. Do the ATP’s agreements address what happens to my data if the ATP is sold to another company? Yes

FARMserver is a product of Beck’s Superior Hybrids, Inc. (“Beck’s”). Under Section 9 of the Data Use Policy, in the event that FARMserver were ever sold, you would be notified and provided an opportunity to delete your Raw Data (excluding weather data) prior to any sale.

FS Advanced Information Services

1. What categories of data does the product or service collect from me?

Section 1 of our Data Access and Use Agreement states that Ag Data is owned by the Customer and Customer has the right to grant access thereto. By using our Services, certain subsets of Ag Data are anonymized and aggregated. Aggregated Data is owned by GROWMARK, as explained in Section 2.b. of our Data Use and Access Agreement. 4. Will the ATP obtain my consent before providing other companies with access to my data? Yes

Section 3.c. of our Data Access and Use Agreement provides that “[i]n the event Company offers additional integrations that allow Ag Data sharing with other third party platforms, Customer’s consent will be obtained before Customer’s Ag Data is disclosed to such third party platforms. 5. After I upload data to the ATP, will it be possible to retrieve my original complete dataset in an original or equivalent format? Yes

Section 2.b. of our Data Access and Use Agreement states that Customer’s original Ag Data will be maintained by Company and may be retrieved by Customer at any time during the life of this Agreement, so long as Customer’s account with Company is current and paid in full. Section 5 of our Data Access and Use Agreement contains a commitment that we will provide notice to the Customer if amending this agreement. More information: Data Access and Use Agreement

Section 4 of the Data Access and Use Agreement states that Company shall notify Customer in the event of a data breach that causes disclosure of Ag Data that has not been authorized by Customer. More information: Data Access and Use Agreement
